1. Introduction

These Terms & Conditions govern all services provided by Grail Hunters Australia (ABN 85 175 242 783) (“Grail Hunters Australia”, “we”, “us”, or “our”).
By engaging our services, submitting collectibles, attending events facilitated by us, or making payment for any service, you (“the Customer”, “Collector”, or “Submitter”) acknowledge and agree to be bound by these Terms & Conditions.
These Terms apply to all services including but not limited to:
  • Comic grading submissions
  • Trading card grading submissions
  • Video game grading submissions
  • Signature witnessing and facilitation services
  • Pressing and cleaning coordination
  • Shipping and logistics handling
  • Event handling and coordination
  • Submission preparation and packaging
  • General collectible facilitation services
Services may involve third-party providers including CGC Grading Services and related affiliated authentication or grading partners.

2. Third-Party Grading & Authentication Services

Grail Hunters Australia acts as a facilitation and dealer service provider.
As an authorised dealer or submission facilitator, we are bound by the terms, conditions, grading standards, turnaround times, policies, and decisions of third-party providers including CGC Grading Services.
By submitting collectibles through Grail Hunters Australia, the Customer agrees to also be bound by all applicable third-party terms and conditions where relevant. Third-party grading outcomes, authenticity opinions, encapsulation decisions, labels, grading standards, signature verification outcomes, restoration detection, and turnaround times are solely determined by the relevant third-party provider.

Grail Hunters Australia does not guarantee:

  • Any specific grade outcome
  • Authentication outcome
  • Encapsulation outcome
  • Pressing result
  • Increase in collectible value
  • Turnaround time
  • Investment performance
All grading opinions are subjective and final as determined by the applicable grading provider.

3. Customer Responsibilities

Customers are responsible for:
  • Accurately declaring collectible values
  • Ensuring collectibles are lawfully owned
  • Packaging collectibles appropriately when shipping to us
  • Reviewing submission details for accuracy
  • Ensuring addresses and contact information are correct
  • Understanding risks associated with grading, shipping, pressing, cleaning, handling, and encapsulation

Customers acknowledge that pressing, cleaning, grading, shipping, handling, and encapsulation may involve inherent risks.

4. Transit, Shipping & Insurance

All collectibles submitted to or returned from Grail Hunters Australia travel at the Customer’s risk unless otherwise agreed in writing.
While reasonable care is taken in handling, packaging, and shipping collectibles, Grail Hunters Australia is not liable for:
  • Loss in transit
  • Theft
  • Postal or courier delays
  • Damage caused during transit
  • Mishandling by shipping providers
  • Customs seizures or delays
  • International freight issues
Limited insurance coverage may apply in certain circumstances; however, insurance is not guaranteed unless expressly confirmed in writing.
Customers are encouraged to obtain their own insurance coverage for high-value collectibles.

5. Limitation of Liability

To the maximum extent permitted under Australian law, Grail Hunters Australia shall not be liable for:
  • Indirect loss
  • Consequential loss
  • Loss of profits
  • Loss of investment value
  • Market fluctuations
  • Emotional distress
  • Missed opportunities
  • Damage caused by third parties
  • Delays outside our control

Our total liability for any claim relating to services provided shall be limited to the amount paid by the Customer for the relevant service.

Nothing in these Terms excludes rights that cannot lawfully be excluded under the Australian Consumer Law.

6. Force Majeure

Grail Hunters Australia shall not be liable for any delay, damage, loss, or failure to perform obligations caused by events beyond reasonable control, including but not limited to:

  • Natural disasters
  • Floods
  • Fires
  • Pandemics
  • Government actions
  • Customs actions
  • Industrial disputes

7. Additional Charges & Pass-Through Costs

The Customer agrees that any additional costs incurred through third parties may be passed on at cost, including but not limited to:
  • Grading fees
  • Shipping surcharges
  • Customs duties
  • Tariffs
  • Taxes
  • Insurance charges
  • Reholder fees
  • Mechanical error fees
  • Signature verification fees
  • Currency conversion impacts
  • Unexpected third-party service charges
Quotes and estimates are indicative only and may change without notice due to exchange rates or third-party pricing changes.

8. Turnaround Times

Any turnaround times provided are estimates only.
Grail Hunters Australia is not liable for delays caused by:
  • Third-party grading providers
  • Shipping carriers
  • Customs processing
  • Event scheduling changes
  • High submission volumes
  • Global logistics disruptions
No refunds shall be provided solely due to turnaround delays outside our control.

9. Advice Disclaimer

Any opinions, advice, recommendations, estimates, or guidance provided by Grail Hunters Australia are provided on a best-effort and non-binding basis only.
We do not provide financial, investment, legal, taxation, or valuation advice.
Collectors remain solely responsible for their own purchasing, investment, and submission decisions.

10. Right to Refuse Service

Grail Hunters Australia reserves the right to refuse any submission, service request, customer, or collectible at our discretion, including where:
  • Items are counterfeit or suspected counterfeit
  • Items are unsafe or unlawful
  • Payment has not been made
  • Submission information is inaccurate
  • Customer conduct is abusive or inappropriate

11. Unpaid Invoices & Abandoned Property

Collectibles may be withheld until all outstanding invoices are paid in full.
Where collectibles remain unclaimed for more than 90 days after notification, Grail Hunters Australia reserves the right to charge storage fees and/or dispose of, return, or sell items where legally permitted to recover outstanding costs.

Reasonable efforts will be made to contact the Customer before any such action occurs.

12. Payments & Chargebacks

Accepted payment methods include:
  • Bank transfer
  • Cash
  • PayPal
Customers agree not to initiate unjustified chargebacks or payment disputes for services already rendered.
Any chargeback fees or recovery costs incurred by Grail Hunters Australia may be recoverable from the Customer.

13. Events & Signature Facilitation

Event appearances, signing schedules, witnesses, and guest participation are subject to change without notice.
Grail Hunters Australia is not liable for:
  • Guest cancellations
  • Signature placement variations
  • Event delays
  • Changes to witnessing availability
  • Authentication outcomes

Where signing opportunities are cancelled by event organisers or talent, refunds or credits may depend entirely on third-party refund policies.

14. Sole Trader Status

Grail Hunters Australia operates as a sole trader business and collector community.

To the maximum extent permitted by law, all services are provided on a limited liability basis.

No personal guarantees are provided beyond obligations required under applicable Australian law.

15. Governing Law

These Terms & Conditions are governed by the laws of Victoria, Australia.
Any disputes arising in relation to these Terms shall be subject to the jurisdiction of the courts of Victoria.
